TERMS AND CONDITIONS

 

These terms and conditions govern your use of our website design service.

Please read the terms in full before you use this Website. If you do not accept

these terms, please do not use this Website design service. Using the Website

implies that you accept these terms. We do occasionally update these terms

so please refer back to them in the future.

 

Quotations

All quotations issued by Design it Wise are valid for a period of

30 days. Design it Wise reserves the right to re-quote after this period.

Payments for the Website Design Service

Design it Wise accepts payments by debit / credit card. Payments for any Web-design

work must be made in advance of the commencement of the project. All fees

are non-refundable.

 

Hosting and Email Service

Design it Wise can provide a web hosting and email services. Web-hosting fees will be

payable approximately 14 days before the hosting expiry date. Our hosting fee

covers both your website and email service. Design it Wise reserve the right to suspend

any website and email accounts where the web hosting has expired and the

customer has not paid the renewal fee. Design it Wise reserve the right to charge a £60

fee to re-activate any website taken offline due to non-payment of the hosting

fee. After a period of 30 days of such suspension, the account will be

permanently terminated and all website files deleted from our servers.

 

Maintenance

Design it Wise highly recommend a maintenance package for the website in order to

keep the website running smoothly. Please note this is an extra services & not part of hosting.

A part of our services, regardless of if you host with us or not, is regular web maintenance built into most of our flat-rate contracts. A common question from prospective clients is what’s the purpose behind website maintenance and what’s included in the package. Here’s an idea what of website maintenance is and why it is so important.

 

Troubleshooting Issues

As a business owner, having your website down means a potential loss of clients. For those who simply buy a website without website maintenance, any sudden issues with the website must be handled separately, and typically billed separately. This means calling up your host and figuring why the website is down, trying to go in and troubleshoot the issue yourself, or waiting on the phone while customer service goes down their dialogue tree to walk you through the issue. Website maintenance with our contracts means that we will troubleshoot any issue, even if it means waiting on hold with your host so you don’t have to (if you opt not to host with us).

From themes to plugins to installed website security, updates are often made to patch security exploits. If your website is left with outdated systems, it is left vulnerable to active hackers, as well as malware and viruses.

Like with security concerns, these same plugins and integrations that run on your website are constantly being updating to improve functionality and reduce issues and errors. Leaving these systems un-updated means missing out on improved features and user experience (at best), and at worst can cause these parts of your website to fail, which can result in part of your website breaking or the entire website going down. Yes, it can happen.

 

Changes to Your Website

Need to change a phone number, update your staff section, or even add a new line of products? Without a maintenance contract, you’re either going to have to put on the web developer hat yourself or sign another contract for the project. We help our clients with minor changes to their website as part of their monthly maintenance contract, though sizable projects may have to be billed separately.  Oftentimes, our clients opt to use it as a “savings” account to where they can “bank” hours to use on a larger project down the road.  Either way – it’s your time to have used however you need.

 

Keeping Up with Best Practices

The internet is a changing place, and so are the best practices that social media, search engines, and other websites employ. For example, you may have heard about how SSL is becoming a mandatory part of browser and search engine experiences, and how going without it can affect how people view and find your website. SSL is a great thing to have on your website, but isn’t a user-friendly installation, and if managed correctly, the labor can be covered under a standard maintenance contract

Website Content Ownership

The customer will own the copyright to the contents of the website after the

website design work has been paid for in full.

 

Logo Design

Design it Wise can design logos for use on your website. Upon project completion the

customer can request a digital copy of the logo for use on all stationary at no

extra cost.

 

Timescales

Design it Wise will provide the client with an estimated project completion date (if

requested). Design it Wise will endeavour to meet any given completion date but does

not guarantee and is not bound in any way to complete the project by this

date. Design it Wise will not be liable for costs incurred, compensation or loss of

earnings due to the failure to meet estimated project completion dates.

 

Quotes & Invoices

All our website packages are for a duration of 12 Months. Should you wish to take your website else where its your responsibility to arrange this and make any transition.  

 

 

 

Refunds

Design it Wise offers 80% money back guarantee and this applies only to the draft

pages. This means you can cancel your order if you are not happy with our

initial designs. 20% of the money will be retained for draft working and

administrative charges to cover costs of the work. To cancel your order simply

request to speak to your project manager who will be happy to assist you. Design it Wise

does not offer refunds when all the web pages have been designed.

 

Termination

Design it Wise expressly reserves the right to terminate or suspend the a client account

without prior notice should the client fail to comply with these Terms and

Conditions or fail to pay an invoice in full as displayed on the invoice or should

Design it Wise deem such action necessary to protect Design it Wise. Under such circumstances

Design it Wise will confirm such termination or suspension by subsequent notice by

email. Design it Wise also reserves the right to terminate any account or withdraw webdesign and/or email services where the relationship between Design it Wise and the customer has broken down. In such an event Design it Wise may issue a refund for any

services paid for in advance but not used.

 

Exclusion of liability

Neither Design it Wise nor any other party (whether or not involved in producing,

maintaining or delivering this Website), shall be liability or responsible for any

kind of loss or damage that may result to you or a third party as a result of

your or their use of our website. This exclusion shall include servicing or repair

costs and, without limitation, any other direct, indirect or consequential loss,

and whether in tort or contract or otherwise in connection with this Website.

Nothing in these Terms shall exclude or limit liability for (i) death or personal

injury caused by negligence (as defined by the Unfair Contract Terms Act

1977); (ii) fraud; (iii) misrepresentation as to a fundamental matter; or (iv) any

liability which cannot be excluded or limited under the law of the United

Kingdom.

 

GOVERNING JURISDICTION

This Legal Notice shall be governed by and construed in accordance with

English law. Any dispute(s) arising in connection with this Legal Notice are

subject to the exclusive jurisdiction of England and Wales.

 

Complaints

Any customer who wishes to make a complaint concerning any of the services

provided by Design it Wise should initially raise the matter with a member of staff with

whom they normally deal or alternatively contact Design it Wise with full details of the

complaint by e-mail to hi@designitwise.com The complaint will then

be passed to the relevant person at Design it Wise.
